Terms of Service

You must be old enough to form a binding contract in your country, or have permission from a parent or guardian. If you accept these terms for an organisation, you confirm you have the authority to bind it.

You are responsible for keeping your login credentials confidential and for all activity under your account. Please keep your account details accurate and up to date.

Chocukat Island is an online creature-breeding game. Players breed, raise, trade, and sell Chocukats, buy in-game coins, commission artwork through Kat Gen, and take part in community features such as forums, the island feed, mailbox messages, and raffles.

Coins, Chocukats, habitats, and other in-game items are licensed digital content within the game. They have no cash value, are not redeemable or exchangeable for money, cannot be withdrawn or cashed out, and may not be sold or exchanged outside Chocukat Island. Buying coins is a purchase of digital game content, not a deposit, wager, or stored-value account.

The weekly raffle is free to enter. No purchase is necessary and no purchase improves your chance of winning. Each signed-in player may enter once per weekly draw, every entry has an equal chance, and entries cannot be bought with coins or money. The prize is an in-game Chocukat with no cash value. Chocukat Island does not offer gambling, wagering, betting, prize competitions of chance requiring payment, or any product where money can be won or withdrawn.

We grant you a limited, non-exclusive, non-transferable right to use the service and the content in your plan for personal, non-commercial enjoyment. You may not reverse engineer the service, resell or redistribute it, or circumvent technical limits, coin costs, or membership requirements.

You must not misuse the service. This includes unlawful activity, fraud, scams, spam, infringing anyone’s intellectual property, harassing other players, uploading harmful or illegal content, and interfering with security — malware, probing, scraping, botting, or automated play. Our Acceptable Use Policy forms part of these terms.

All Chocukat artwork, line art, sprites, software, branding, and documentation remain the property of Chocukat. Buying a Chocukat, or commissioning a pup through Kat Gen, gives you a personal licence to display and use that art within the game and for personal, non-commercial use — it does not transfer copyright or grant commercial rights.

You keep ownership of content you upload (profile pictures, status updates, forum posts, commission briefs) and grant us a limited licence to host and display it in order to run the service. You must have the rights to anything you upload. If you believe content on the island infringes your rights, contact us through the contact page and we will review and remove infringing material. Repeat infringers lose their accounts.

New players get a 7-day free trial. After the trial, an active membership ($15 for six months or $25 per year) is required to keep your Chocukats. Coins can be purchased separately at the rate shown on the pricing page.

Payment, billing, currency, tax, cancellation, and refund mechanics are handled by Paddle under the Paddle Buyer Terms. See our Refund Policy for how refunds work.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

We work hard to keep the island online, but we do not guarantee that the service will be uninterrupted, error-free, or free from loss of data. Features, prices, genetics rules, and game balance may change over time. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

We may suspend or terminate your access for material breach of these terms, non-payment or an expired membership, security or fraud risk, or repeated or serious policy violations. You may stop playing and close your account at any time. When access ends, in-game items and unspent coins are forfeited and your data is handled as described in our Privacy Policy.

To the fullest extent permitted by law, we are not liable for indirect, consequential, or special damages, including lost profits, lost data, or lost goodwill. Our total aggregate liability is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms excludes liability for fraud, death, or personal injury where the law does not allow it.

You agree to indemnify us against claims arising from content you upload, your unlawful use of the service, or your breach of these terms.

We may update these terms; continued use of the service after an update means you accept the revised terms. You may not assign your rights without our consent; we may assign ours as part of a merger or acquisition. Neither party is liable for delays caused by events beyond their reasonable control. These terms are governed by the laws of the seller’s home jurisdiction, and disputes will be resolved in its courts.
